Easements

TQM Pipeline has acquired approximately 2000 rights of superficies, of which 1500 are for its pipeline between St-Lazare and St-Nicolas and 500 for the extension of company's system between Lachenaie and East Hereford. These rights, commonly called easement rights, apply to each property crossed by the pipeline to permit the maintenance of the pipeline and to assure the security of company's installations. This easement right is applicable to the width of the pipeline right-of-way which is generally 23 metres wide.

Even with the presence of the pipeline, the landowner continue to enjoy his land. However, a landowner must obtain a written authorization from TQM Pipeline before starting any construction activity in the pipeline right-of way. This authorization will assure TQM Pipeline that the activity will not have any negative impact on the efficient and secure operation of the pipeline.

Since one of the principal threats to the pipeline integrity is the damage caused by third parties during excavation and construction activities, the National Energy Board has adopted regulations with regard to construction activities in the vicinity of pipeline facilities. In fact, pursuant to the National Energy Board Pipeline Crossing Regulations, a written permission from TQM Pipeline should be obtained for any construction or digging activities crossing the pipeline or for any digging activities located at less than 30 metres from the pipeline right-of-way.

Many elements of TQM Pipeline's maintenance program aim to prevent any unauthorized activity in its right-of-way. In this regard, the following activities can be underlined:

• aerial inspection;
• maintenance of a clean right-of-way;
• maintenance of a permanent signalisation.

In addition, TQM Pipeline has established an awareness program to inform the public of the presence of the pipeline in the regions where its pipeline crosses. The pipeline system operated by TQM Pipeline is on private property. Access is prohibited at all times without permission from the landowners.
